These Terms of Service (“Terms”) govern your access to and use of uppl.ee (the “Service”), an image hosting platform operated by uppl.ee (“we,” “us,” or “our”). By creating an account, purchasing a plan, uploading content, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1) Eligibility and Accounts

  1. Account required. An account is required to upload images and use account features.
  2. Accurate information. You agree to provide accurate information and keep it up to date.
  3. Account security. You are responsible for all activity under your account and for safeguarding your credentials. Contact us immediately if you suspect unauthorized access.

2) The Service and Visibility Options

uppl.ee allows you to upload, store, and share images with different visibility settings:

  • Private: intended to be accessible only to you via your account.
  • Unlisted: accessible to anyone with the link; may not appear in public listings.
  • Public: accessible to anyone and may appear in public listings or discovery features.

You understand that anyone you share a link with (unlisted/public) may copy or re-share content, and we cannot control how third parties use content after it is shared.

3) Your Content; License to Us

  1. You own your content. You retain all rights you have in the images and other materials you upload (“User Content”).
  2. License you grant. You grant us a worldwide, non-exclusive, royalty-free license to host, store, cache, back up, reproduce, transmit, display, and distribute your User Content, and to process/modify it solely for technical purposes (e.g., resizing, compression, format conversion, generating thumbnails) as necessary to operate, secure, and improve the Service and to display/share content according to your chosen visibility settings.
  3. No sale of your content. Except as needed to provide the Service, we do not claim ownership of your User Content.

4) Content Rules (NSFW Not Allowed)

You agree not to upload, post, transmit, or share User Content that:

  1. Is NSFW or sexually explicit (including pornography, explicit nudity intended for sexual gratification, or sexual acts).
  2. Exploits or sexualizes minors (strictly prohibited).
  3. Violates law or others’ rights (including copyright, trademark, privacy, or publicity rights).
  4. Is used to harass, threaten, or harm others.
  5. Contains malware or is used for phishing/scams.

We may remove content and take enforcement actions (including suspension/termination) for violations.

5) Acceptable Use

You agree not to:

  1. Attempt to bypass access controls, security features, or visibility settings.
  2. Scrape, crawl, or mass-download content in a way that harms the Service or violates others’ rights.
  3. Overload or disrupt the Service (including abusive automation).
  4. Reverse engineer or interfere with the Service except to the extent permitted by applicable law.

6) Copyright and Takedowns

If you believe content on uppl.ee infringes your copyright or other IP rights, contact:

Please include:

  • Identification of the work claimed infringed,
  • A link or sufficient info to locate the material,
  • Your contact information, and
  • A good-faith statement that the use is not authorized.

We may remove or restrict access to content and may act against repeat infringers where appropriate.

7) Paid Plans, Billing, and Refunds

  1. Plans and features. uppl.ee may offer paid plans with additional features (e.g., higher storage, bandwidth, or premium tools). Plan details are described at [Pricing Page URL] and are incorporated into these Terms.
  2. Fees and taxes. You agree to pay all applicable fees and taxes for your selected plan.
  3. Billing and renewal. If your plan is subscription-based, it will renew automatically unless you cancel before the renewal date (as described in your account settings or the pricing page).
  4. Payment processing. Payments may be processed by a third-party payment provider. Your payment is also subject to that provider’s terms and privacy policy.
  5. Plan changes. If you upgrade/downgrade, changes may take effect immediately or at the next billing cycle depending on the plan rules shown at purchase time.
  6. Non-payment. If payment fails or is reversed, we may suspend or downgrade your paid features until payment is resolved.

8) Storage, Retention, and Deletion

  1. Limits. We may impose limits on file types, file sizes, storage, bandwidth, retention, and other usage characteristics, including differing limits by plan.
  2. Deletion by you. You may delete your images and/or your account subject to any verification steps and legal/operational constraints.
  3. Residual copies. Deleted content may remain in backups, logs, or caches for a limited time. We are not responsible for copies retained by third parties who had access to your content.

9) Moderation, Enforcement, and Termination

  1. Moderation. We may (but are not required to) monitor, review, or remove User Content.
  2. Enforcement. We may warn, restrict, suspend, terminate, or otherwise limit access if we believe you violated these Terms or if necessary to protect the Service, users, or third parties.
  3. Termination effect. Upon termination, your access may be removed and your content may be deleted or made inaccessible, subject to backups and legal obligations.

10) Privacy and GDPR (EEA / UK)

uppl.ee is U.S.-based (United States). If you are located in the European Economic Area (EEA), United Kingdom, or Switzerland, you may have additional rights under the GDPR/UK GDPR.

10.1 Controller, purposes, and legal bases

For personal data we process as part of providing the Service, uppl.ee typically acts as a data controller.

We process personal data for purposes such as:

  • Providing the Service (creating accounts, hosting images, enabling sharing, customer support) — legal basis: performance of a contract (GDPR Art. 6(1)(b))
  • Security and abuse prevention (fraud detection, investigating violations) — legal basis: legitimate interests (Art. 6(1)(f)) and/or legal obligations (Art. 6(1)(c))
  • Payments and subscriptions (billing, invoices, fraud prevention) — legal basis: performance of a contract (Art. 6(1)(b)) and legal obligation (Art. 6(1)(c))
  • Service improvement and analytics — legal basis: legitimate interests (Art. 6(1)(f)) and, where required, consent (Art. 6(1)(a))

10.2 International transfers

If you are in the EEA/UK, your data may be transferred to and processed in the United States and other countries where we or our service providers operate. Where required, we use appropriate safeguards (such as Standard Contractual Clauses) and other lawful transfer mechanisms described in the Privacy Policy.

10.3 Your GDPR rights

Depending on your location and the data, you may have rights to:

  • Access your personal data
  • Correct inaccurate data
  • Delete data (“right to be forgotten”)
  • Restrict or object to certain processing
  • Data portability
  • Withdraw consent (where processing is based on consent)

10.4 Data retention

We keep personal data only as long as necessary for the purposes described, including legal, billing, security, and dispute resolution needs. Retention details are described in the Privacy Policy.

10.5 Complaints

If you are in the EEA/UK, you may lodge a complaint with your local data protection authority. We encourage you to contact us first so we can try to resolve your concern.

11) Disclaimers

The Service is provided on an “AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted service or that content will always be available.

12) Limitation of Liability

To the fullest extent permitted by law:

  1. We are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenues, data, goodwill, or business opportunities.
  2. Our total liability for any claim related to the Service will not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $100 USD.

Some jurisdictions do not allow certain limitations; in such cases, limitations apply to the maximum extent permitted by law.

13) Indemnification

You agree to defend, indemnify, and hold us harmless from claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your User Content, or your violation of these Terms or applicable law.

14) Changes to These Terms

We may update these Terms from time to time. If changes are material, we will provide notice (for example, by posting an update on uppl.ee or by email). Continued use after the effective date means you accept the updated Terms.

15) Governing Law and Venue (U.S.)

These Terms are governed by the laws of the State of Zurich, excluding conflict-of-law rules. You agree that disputes will be brought in the state or federal courts located in Switzerland, unless applicable law requires otherwise.
